We are experienced in advising about and preparing various types of Power of Attorney.  This is a legal document that empowers someone else to take actions or make decisions on your behalf.  You choose the person (or persons) you want to help you, called an “Attorney”, and decide what powers they should have.  This can range from a simple Power of Attorney for a specific reason, e.g. in favour of one’s spouse in connection with signing documents in a property transaction, through to setting up a registered Continuing and Welfare Power of Attorney with the Office of The Public Guardian, whereby, should the granter become incapable of looking after their own affairs, the Attorney can step in and look after everything on their behalf ensuring, for instance, that their money is properly administered and all bills paid.  The Law Society of Scotland recommend that everyone over the age of 50 grants a close and trusted individual the power to deal with their affairs in the event that they are unable to do so.
